[...] Steps two and three assess the ways a government chooses to advance its purpose: Does the restriction rationally advance the law’s purpose, and if so, does the law restrict the right no more than is necessary to achieve that objective? The final part of the Oakes test considers whether the benefit of the restrictive measure is proportionate to its impairment of the freedom.
