The corruption, and low- capacity of state land and property institutionosv,e grnment organizations and personnel results in a reduction of resources, the departure of pnenreslo, and the degradation of the institutions responsible for conducting and enforcing formadl l aringhts procedures. [...] The legitimacy of the formal land tenure system can be further reduced in wlatre-rde situations because of the system’s connection to the state if the government is pfa trht eo war or occupied part of the state’s terri tory in the war, which is very often the case. [...] Customary tenure in conflict contexts The practical reality in situations of low governnmt ecapacity in land administration after a crisis will be that customary and other forms of informteanl ure will be the prevailing form of tenure for the majority of the population. [...] The much lower capacity of the rebel armed factions (compared to govern)m oenn tland issues, and the technical prospects for achieving their objectives with regard to larnigdh ts in peace negotiations was so problematic that it led the UN to try to bring in outside tecichanl expertise for the purpose of advising the rebel factions during the peace negotiations in aD, oQhatar. [...] While this may be the case, the urgency with which many land issues need to bet dweitahl during and after a crisis in order to avoid renewed armed conflict, together with theu vmoel , and the need to communicate to the populace that the recovering government is quicakttleyn ding to the many thorny land issues, are primary considerations as well.
