Planning staff have reviewed the applicant’s development proposal and requested variance within the context of the policies of the Official Plan and the provisions of the applicable Zoning By-law. [...] In this regard, the requested relief from the by-law, as proposed, is considered minor in nature, is appropriate for the development of the land, and meets the general intent of the applicable zoning by-law and of the City’s Official Plan. [...] Planning staff has reviewed the applicant’s development proposal within the context of the neighbourhood, as well as the policies of the Official Plan and the provisions of the Committee of Adjustment Agenda: March 23, 2023 Page 30 of 36 applicable Zoning By-law. [...] On the basis of the preceding, staff are of the opinion that the Consent Application B003/23 complies with the criteria listed under Section 51(24) of the Planning Act and conforms to the City’s Official Plan.
